"ABOUT FACE"

FACE, the federal Freedom of Access to Clinic Entrances Act (18 U.S.C. § 248), has the potential to be used in an ideologically more balanced manner, i.e., not just to target pro-life activists. Recent case law and statutory analysis support the idea that FACE may prohibit the following, when committed "by force or threat of force or by physical obstruction":

  • Coerced abortions (or sterilizations or birth control), whether the coercion is applied by boyfriends, parents, teachers, abortion clinic staff, or others;
  • Interference with sidewalk counselors who refer women to pregnancy help centers, including physical assaults by abortion escorts or security guards;
  • Interference with pro-life pregnancy help centers, including vandalism or threats by phone or mail; and,
  • Interference with religious activities taking place at a place of worship, including vandalism or attacks on clergy or members of the congregation.

The Civil Rights Division of the U.S. Department of Justice (DOJ) is responsible for enforcing FACE. We urge those aware of potential FACE cases like those listed above to bring the facts to the attention of the DOJ in a timely manner. Private attorneys can also bring FACE lawsuits in situations like those listed above.
