Asks Florida Court to Permit Intervention of Terri Schindler Schiavo's
Parents to Enter Constitutional Case

(Clearwater,
FL) - The American Center for Law and Justice, an international
public interest law firm specializing in constitutional law, today
filed a motion in Florida state court to intervene on behalf of
Robert and Mary Schindler - the parents of Terri Schindler Schiavo
- in a lawsuit brought by Michael Schiavo and supported by the ACLU
challenging the constitutionality of the actions of Florida Governor
Jeb Bush and the Florida legislature in ordering life-saving measures
to be restored to Terri Schindler Schiavo.
"This
is a very important case involving the state's ability to act to
protect human life," said Jay Sekulow, Chief Counsel of the
ACLJ. "We believe the lawsuit is legally flawed and that both
the legislature and the Governor are well within their constitutional
authority to take actions to save the life of Terri Schindler Schiavo.
We are asking the court to permit the parents to intervene on this
legal challenge and we're hopeful the court will agree."
Last week,
the Florida legislature passed a bill that has become known as "Terri's
Law" - legislation that gave Governor Jeb Bush the authority
to order Terri's feeding tube re-inserted and her nutrition and
hydration resumed. Michael Schiavo, Terri's husband, has filed suit
challenging the constitutionality of the actions of the legislature
and the Governor.
The American
Civil Liberties Union has announced that it will join with Michael
Schiavo in this legal challenge. In addition to filing suit challenging
the constitutionality of the state's action, Schiavo has also asked
the court for an injunction to remove the life-saving measures that
have been re-instated.
"It is
clear the Governor has the constitutional authority to act to save
the life of someone on death row," said Sekulow. "This
case is no different. What the legislature and the Governor did
is not only appropriate, but legally sound and constitutional as
well. We are hopeful that the court will permit Terri's parents
to enter this case and we look forward to working with the Governor's
office and the state Attorney General to defend the life-saving
actions of the state in court."
The ACLJ today
filed the motion to intervene in the case of Schiavo v. Bush in
the Circuit Court for Pinellas County in Clearwater, FL. There is
no word on when the court will consider the motion.
The ACLJ is
representing the parents in only one aspect of this ongoing case
- the legal challenge to the constitutionality of the actions of
the Governor and state legislature. Patricia Fields Anderson, an
attorney in St. Petersburg, is representing Terri's parents in all
other aspects of the case.
